A Statutory Will is different from a standard Will and requires expert knowledge as it is there to protect a person who lacks capacity. This lack of capacity can arise through medical conditions such as dementia or head injury. The Court of Protection is authorised to make such a Will but it requires expert knowledge as the process can often be long and arduous as there are many forms to complete with medical and witness evidence to gather.
