Insolvent employers

During this time of the pandemic unfortunately many business are becoming insolvent, leaving employees who have valid claims in difficult circumstances.

Fortunately as the Court of Appeal held in Irwell Insurance Co Ltd v Watson [2021] an employment tribunal has decided that an employee can bring a claim against their former employer’s insurer under an insurance policy covering tribunal awards. This is great news for employees, although finding out whether the insolvent employer had an insurance policy may be the challenge.
