As a family lawyer I always think I’ve seen it all; however, it’s always the next case that proves otherwise.

Recently I represented a wife who believed that the husband, a banker, has hidden monies. There is always a difficult choice to be made; whether to spend money and resources and take the risk that perhaps nothing is going to be found. On the other hand, as a solicitor, you cannot dismiss your client’ allegations.

The wife had spent a significant amount of money to find absolutely nothing. The biggest issue she had is not with her suspicion and what she knew but proving it in court.

In my experience clients address the issue from an emotional point of view rather than strictly commercial, which I know is difficult but in my view correct.

It is sad and frustrating when you know that the other party hides funds; however, my clear advice is not to embark on a “witch hunt” unless supported by concrete evidence.

If such evidence exists then the second question to consider is proportionality. How much money is going to be spent against the amount recovered?
