A very ‘rare’ costs Order which could save you £000,000s!

The High Court has recently heard a divorce case which has resulted in a rare Order regarding costs.
Generally in Matrimonial proceedings costs are not awarded to the other person but each pays their own. The exception is if the Court feels one party has behaved inappropriately and this was the case here. In the case of Joy -v- Joy-Morancho & Ors the Court heard that not only had the husband tried to hide the true value of his assets he blatantly lied to the court about the evidence of a witness.
The Court took a dim view of this behaviour and took the unusual step of ordering the husband to pay the wife’s legal costs, amounting to £334,000, which he had to pay within 14 days.
The moral of the story has to be that full, frank and accurate financial disclosure is a must.
